1. Who We Are
Real Time Ordering ("RTO," "we," "us") provides online ordering, websites, branded apps, loyalty, marketing and integration software to restaurants ("Merchants"). This Privacy Policy explains how we collect, use and share personal information through our websites, the Command Center merchant portal, and the ordering sites, apps and integrations we operate for Merchants (the "Services").
When a diner orders from a Merchant through the Services, we process that diner's information on the Merchant's behalf to complete the order. The Merchant's own privacy practices also apply to its customers.
2. Information We Collect
- Merchant account information: business name, locations, contact names, email addresses, phone numbers, login credentials, and billing details.
- Order information: items ordered, order totals, pickup or delivery details, delivery address, name, phone number and email of the person ordering, and special instructions.
- Loyalty and marketing information: phone number, name, birthday and points history for customers who join a Merchant's loyalty program, and their text or email marketing preferences.
- Payment information: card payments are processed by our payment-processing partners. We receive transaction details such as amount, status, card type and the last four digits.
- Third-Party Platform information: when a Merchant connects a platform such as DoorDash, Uber Eats or Grubhub, we receive store identifiers, menu and store status information, orders placed through that platform, and the access credentials or tokens needed to maintain the connection.
- Device and usage information: IP address, browser and device type, pages viewed, referring pages, and similar information collected automatically, including through cookies and similar technologies.
3. How We Use Information
- to provide the Services, including placing, routing and fulfilling orders, publishing menus, and running loyalty programs;
- to send order confirmations, receipts, status updates and service communications;
- to send marketing messages on a Merchant's behalf where the recipient has opted in;
- to provide customer support, prevent fraud and abuse, and keep the Services secure;
- to understand how the Services are used and to improve them; and
- to comply with legal obligations and enforce our agreements.
4. How We Share Information
We share personal information only as needed to operate the Services:
- With the Merchant you order from or whose loyalty program you join;
- With service providers that act for us, such as payment processors, hosting, messaging and delivery-dispatch providers;
- With POS systems and Third-Party Platforms that a Merchant has connected, to transmit orders and keep menus, availability and store status in sync;
- For legal reasons, when required by law or to protect the rights, safety and property of RTO, Merchants, customers or others; and
- In a business transfer, such as a merger or acquisition, subject to this Privacy Policy.
We do not sell personal information.
5. Text Messages and Email
If you opt in to texts or emails from a Merchant through the Services, you may receive order updates, loyalty notices and offers. Message frequency varies and message and data rates may apply. You can reply STOP to any text to opt out, or use the unsubscribe link in any marketing email. Order-related messages may still be sent to complete an order you place.
6. Cookies
We use cookies and similar technologies to keep you signed in, remember your cart, measure site traffic and, where a Merchant has enabled them, support that Merchant's analytics and advertising tools. Most browsers let you block or delete cookies, though some features may not work without them.
7. Security
We use administrative, technical and physical safeguards designed to protect personal information, including encryption in transit (TLS) and restricted access to systems and data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Retention
We keep personal information for as long as needed to provide the Services, to meet a Merchant's record-keeping needs, and to comply with legal, tax and accounting obligations, and then delete or de-identify it.
9. Your Choices and Rights
You can ask to access, correct or delete personal information we hold about you by emailing [email protected]. If your request concerns information held on behalf of a Merchant, we may refer it to that Merchant. Depending on where you live, including California, you may have additional rights under applicable law, and we will not discriminate against you for exercising them.
10. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will post changes on this page with a new effective date and, for material changes, provide additional notice where required.
